 1.       Approval of Minutes from July 16, 2019 regular meeting (Action Item)

2.       Public Meeting: Buffer Alternative Compliance Teton Science School
Teton Science School is requesting an alternative compliance measure for the required buffer on the east side of the property where the Civic (CIV) zone abuts a Residential Multi-Family (RM-1) zone. The applicant has submitted a letter from the neighboring property owner agreeing to the alternative compliance request. The request is to maintain the current 4’ tall fence and 17 trees with the addition of four more tress. Furthermore, the applicant is requesting to replace the barbed wire fence that is located between the neighboring property and 195 w center St. with a similar style post and rail fence. .0(Action Item)

Review Criteria (Div. 11.2.2.G):
1. The existing topography or vegetation achieve the purpose and intent of this Division.
2. For topographic reasons, a fence or wall or other required screening device could not screen activities from an abutting property as required by this Division.

3.       Continued Public Hearing: ZX2019-05 1208 Hwy 31 Teton Valley Resort
Keith Larsen, representing Teton Valley Resort, has requested a Rezone Map Amendment for three (3) parcels associated with the resort.  The request would rezone the property from Residential Multi-Family 1 (RM-1) and Residential Multi-Family 2 (RM-2) to Recreation (REC).  This request is an attempt to bring a non-conforming use into compliance with the zoning and use standards found in Title 10 of the Municipal Code. This request includes parcel numbers: RPB3N45E108201, RPB3N45E107802, and RPB3N45E107801.  (Action Item)

Review Criteria (Section 14.7.11.B):
1.       The Zoning Map Amendment substantially conforms to the Comprehensive Plan.
2.       The Zoning Map Amendment substantially conforms to the stated purpose and intent of this Code.
3.       The Zoning Map Amendment will reinforce the existing or planned character of the area.
4.       The subject property is appropriate for development allowed in the proposed district.
5.       There are substantial reasons why the property cannot be used according to the existing zoning.
6.       There is a need for the proposed use at the proposed location.
7.       The City and other service providers will be able to provide sufficient public facilities and services including schools, roads, recreation facilities, wastewater treatment, water supply and stormwater facilities, police, fire and emergency medical services, while maintaining sufficient levels of service to existing development.
8.       The Zoning Map Amendment will not significantly impact the natural environment, including air, water, noise, stormwater management, wildlife, and vegetation.
9.       The Zoning Map Amendment will not have a significant adverse impact on property in the vicinity of the subject property

4.       Public Hearing: SD2019-02 Mountainside Village Preliminary Plat Phase 3B Application
Mountainside, Inc. has requested a Preliminary Plat approval for phase 3B. Phase 3B has 16 residential lots. The proposed zoning for all the lots in phase 3B is RS-7. The intent with phase 3B is to follow the originally adopted masterplan. Phase 3B obtained Concept Plan approval on July 17, 2018. The request includes parcels: RPB3N45E130603. (Action Item)

Review Criteria (Div. 14.5.10.C.8.):
1. Recommendations of the Administrator, including recommendations from internal City departments and external agencies;
2. Compliance with the applicable requirements of the Land Development Code. Substantial conformance with the City’s applicable adopted plans and policies

5.       Public Hearing: SD2019-03 Mountainside Village Preliminary Plat Phase 3A Application
Mountainside, Inc. has requested a Preliminary Plat approval for Phase 3A. Phase 3A has 30 residential lots and one common lot. The proposed zoning of the property is RS-3, and RS-5. The intent with phases 3A is to follow the originally adopted masterplan. Phase 3A obtained Concept Plan approval on July 17, 2018. The request includes parcels: RPB3N45E130603. (Action Item)

Review Criteria (Div. 14.5.10.C.8.):
1. Recommendations of the Administrator, including recommendations from internal City departments and external agencies;
2. Compliance with the applicable requirements of the Land Development Code. Substantial conformance with the City’s applicable adopted plans and policies

6.       Work Session: Large Non-Residential Applications.
City Council identified large non-residential projects at the May 22, 2019 regular meeting as a development type that may require modification to the current development standards. At the June 26, 2019 regular meeting Council directed staff and Planning and Zoning Commission to study in further detail two potential solutions that were identified in that meeting.
